

L’ORGANE REPRÉSENTATIF DE SAINT-CASTIN
Le Conseil législatif est l’organe représentatif du Neugraviat de Saint-Castin. Il exerce les fonctions qui lui sont confiées par la Constitution et les lois, notamment dans les domaines de la législation, des finances publiques, du contrôle de l’administration et des engagements internationaux de l’État.
Dans l’exercice de ses fonctions, le Conseil représente la population castinienne et contribue à la protection de ses droits et de ses intérêts. Il participe également à la continuité des institutions et au fonctionnement de l’État en collaboration avec le Neugrave et le Gouvernement.
Depuis la réforme électorale de 2024, le Conseil législatif est composé de cinq membres élus dans autant de circonscriptions territoriales pour un mandat de deux ans.
Dans la province de l’Outaragasipi, les circonscriptions de DeLorimier, Bouc et Cherrier sont représentées par le Parti travailliste castinien. Dans la province du Valinois, DeQuen est représentée par le Parti ouvrier catholique et Simard par la Coalition démocratique castinienne.
POUVOIR LÉGISLATIF
Le Conseil législatif participe à l’exercice du pouvoir législatif. Il examine, débat, modifie et adopte les projets de loi conformément à la Constitution et aux règles régissant la procédure législative.
Son intervention permet l’examen collectif des mesures soumises à l’État et assure que leur adoption respecte les exigences constitutionnelles. Le Conseil intervient également dans les procédures relatives aux traités et aux autres engagements internationaux lorsque son approbation est requise.
En matière financière, il participe à l’examen et à l’adoption du budget ainsi qu’aux décisions concernant les impôts et les autres contributions publiques.
CONTRÔLE DU GOUVERNEMENT ET DE L’ADMINISTRATION
Le Conseil législatif exerce un contrôle parlementaire sur le Gouvernement et l’administration publique dans les limites prévues par la Constitution et les lois.
Il peut demander des renseignements, adresser des questions aux membres du Gouvernement et constituer des commissions d’enquête lorsque les circonstances le justifient. Ces mécanismes contribuent à la transparence, à la responsabilité gouvernementale et au respect de la légalité dans l’exercice des fonctions publiques.
Lorsque les conditions prévues par le droit castinien sont réunies, le Conseil peut également engager les procédures permettant de mettre en cause la responsabilité d’un membre du Gouvernement devant la Cour d’État pour une violation de la Constitution ou des lois.
FONCTIONNEMENT DU CONSEIL
Le Conseil législatif se réunit conformément aux règles prévues par la Constitution, les lois et son règlement intérieur. Ses membres exercent leur mandat dans l’intérêt de la population et participent personnellement aux travaux du Conseil.
Au début de leur mandat, les membres prêtent le serment prévu par le droit castinien et s’engagent à respecter la Constitution et les lois.
Le Conseil élit ou désigne sa présidence conformément aux règles applicables. La présidence dirige les séances, veille au bon déroulement des délibérations et exerce les autres fonctions que lui attribuent les textes en vigueur.
Le quorum correspond aux deux tiers du nombre légal de membres. Sauf disposition contraire, les décisions sont prises à la majorité absolue des membres présents.
CONSULTATIONS POPULAIRES
Le Conseil législatif peut recourir à la consultation populaire dans les situations prévues par la Constitution et les lois.
Une consultation peut notamment porter sur certains principes d’une mesure législative. Les décisions concernant la ratification d’un traité international peuvent également être soumises à la population lorsque le Conseil en décide ainsi ou lorsque les conditions permettant d’en demander la tenue sont réunies.
La consultation populaire complète ainsi le fonctionnement représentatif des institutions sans se substituer au rôle législatif du Conseil.
RÈGLEMENT INTÉRIEUR ET STATUT DES MEMBRES
Le Conseil législatif adopte son règlement intérieur conformément à la Constitution. Celui-ci encadre notamment l’organisation des séances, les délibérations, les procédures internes et l’exercice des fonctions parlementaires.
Les indemnités et, le cas échéant, les frais de déplacement liés à l’exercice du mandat sont déterminés conformément à la loi.
Par ses fonctions législatives, financières et de contrôle, le Conseil législatif constitue l’un des principaux organes de l’ordre constitutionnel castinien. Il assure la représentation des circonscriptions, participe à l’élaboration des lois et contribue à la responsabilité des institutions publiques.
REPRESENTATIVE BODY OF SAINT-CASTIN
The Legislative Council is the representative body of the Newgraviate of Saint-Castin. It exercises the functions entrusted to it by the Constitution and the laws, particularly in the fields of legislation, public finance, oversight of the public administration and the State’s international commitments.
In carrying out its functions, the Legislative Council represents the Castinian population and contributes to the protection of its rights and interests. It also contributes to institutional continuity and the functioning of the State in cooperation with the Newgrave and the Government of Saint-Castin.
Since the 2024 electoral reform, the Legislative Council has consisted of five members elected from five territorial constituencies for two-year terms.
In the province of Outaragasipi, the constituencies of DeLorimier, Bouc and Cherrier are represented by the Castinian Labour Party. In the province of Valinois, the constituency of DeQuen is represented by the Catholic Workers Party and the constituency of Simard by the Castinian Democratic Coalition.
LEGISLATIVE POWER
The Legislative Council participates in the exercise of legislative power. It considers, debates, amends and adopts bills in accordance with the Constitution and the rules governing the legislative process.
Its participation provides for collective consideration of measures submitted to the State and helps ensure that their adoption complies with constitutional requirements. The Legislative Council also participates in procedures concerning treaties and other international commitments when its approval is required.
In financial matters, it participates in the consideration and adoption of the budget and in decisions concerning taxes and other public contributions.
OVERSIGHT OF THE GOVERNMENT AND PUBLIC ADMINISTRATION
The Legislative Council exercises parliamentary oversight of the Government of Saint-Castin and the public administration within the limits established by the Constitution and the laws.
It may request information, address questions to members of the Government and establish committees of inquiry when circumstances warrant. These mechanisms contribute to transparency, government accountability and respect for the rule of law in the exercise of public functions.
Where the conditions established by Castinian law are met, the Legislative Council may also initiate proceedings concerning the responsibility of a member of the Government before the Court of State for a violation of the Constitution or the laws.
PROCEEDINGS OF THE LEGISLATIVE COUNCIL
The Legislative Council meets in accordance with the rules established by the Constitution, the laws and its Rules of Procedure. Its members exercise their mandates in the interests of the population and participate personally in the proceedings of the Legislative Council.
At the beginning of their terms, members take the oath prescribed by Castinian law and undertake to uphold the Constitution and the laws.
The Legislative Council elects or designates its President in accordance with the applicable rules. The President presides over sittings, ensures the orderly conduct of deliberations and exercises the other functions assigned by the applicable legal framework.
A quorum consists of two-thirds of the legal membership of the Legislative Council. Unless otherwise provided, decisions are taken by an absolute majority of the members present.
POPULAR CONSULTATIONS
The Legislative Council may provide for a popular consultation in the circumstances established by the Constitution and the laws.
A consultation may concern certain principles contained in proposed legislation. Decisions concerning the ratification of an international treaty may also be submitted to the population when the Legislative Council so decides or when the conditions for requesting such a consultation are met.
Popular consultation therefore complements the representative character of Saint-Castin’s institutions without replacing the legislative role of the Legislative Council.
RULES OF PROCEDURE AND STATUS OF MEMBERS
The Legislative Council adopts its Rules of Procedure in accordance with the Constitution. These rules govern, among other matters, the organization of sittings, deliberations, internal procedures and the exercise of parliamentary functions.
Allowances and, where applicable, travel expenses associated with the exercise of a member’s mandate are determined in accordance with the law.
Through its legislative, financial and oversight functions, the Legislative Council constitutes one of the principal bodies of the Castinian constitutional order. It ensures constituency representation, participates in the making of laws and contributes to the accountability of public institutions.
